What is Title of a Property (Real Estate)?

The title of a property is the right of ownership of the property. In fact, the title of a property is a set of rights available to the owner of the property. These rights include the right to possess the property; the right to use the property; the right to let out the property; the right to sell the property; etc.
A document that shows that a person has the title of a property is called a title deed. A title deed shows the particulars of a property, including the land area, details of any buildings, nature of its use, its value, the name of the person from whom the present owner got the title, etc.


What is transfer of a property?

Transfer of a property means transfer of its title from one person to another person. For example, when Mr. B buys a property from Mr. A, the TRANSACTION OF BUYING represents TRANSFER.
Therefore,

Transaction of Buying = Transfer

Other transactions which can represent transfer include inheritance, gift, etc.


Who transfers a property?

A person who has the title of a property can transfer the title of the property to another person.

The point to note is that, in the matter of real estate ownership (and in other legal matters as well), a person is not simply a human being. The word “person” includes many entities other than human persons. Examples are companies, trusts, associations of persons, and firms. In the eye of the law, all these are persons and can have title of a property. Hence, they can also transfer title of a property to other persons.

One important requirement for property transfer is that the person transferring the property to another person must have a title of the property. Essentially, the person selling the property cannot transfer a title better than his own title. For example, a person having title of a 2,500 square foot piece of land cannot transfer 2,501 square feet of land.


Where is transfer of a property made?

When a person transfers a property to another person, the transfer is recorded in government records.

A document showing the transaction details is prepared as a copy of record available from the government as evidence of the transfer. This document is called a deed, sale deed, sales deed, registered deed, registry, or registered transfer deed.


When is a transfer of property needed?

Probably the most common time a transfer of property is needed is at the time of the property's sale. This is when a property changes hands; it gets transferred from one person to another person.

Another common time that property transfer is needed is upon the death of a person having title of a property. When this happens, the property becomes property without an owner. Generally, such properties are supposed to be transferred to the legal heirs of the deceased person. However, the transfer does not happen automatically; it needs to be entered into government records by the legal heirs.

Other times of need for property transfers include the need for transfer for the purpose of giving property as a gift, acquiring property for a project, etc.


How costly is a transfer of a property?

The transfer of property is not free; in fact, it generally involves a high cost, which varies directly with the cost of the property or real estate being transferred. The higher the cost of a property, the higher the cost of its transfer.
The cost of transfer is not included in the price of the property under transfer. That is why the total cost to buy a property is higher than the price agreed between the seller and the buyer of the property.

The transaction cost of transfer of a property includes:


1.   Transfer Fee;
2.   Stamp Duty;
3.   Capital Value Tax; and
4.   Other Taxes

In simple equation form:

Cost of buying a property = Price of the property plus transfer taxes
 

This means that taxes add to the cost of real estate for sale.

Generally, a property or real estate is subject to taxes from all three levels of governance in a country, i.e., federal government, provincial or state government, and local government.

Examples of federal government taxes include income tax on rental income arising from a property and short-term capital gains tax arising from sale of property within a short period.

Examples of provincial government or state taxes include stamp duty and registration fees.

Examples of local government taxes include fees for transfer of a property in local records and map fees.


What are the taxes on transfer of a property?

The transfer taxes on a property are collected at the time of the transaction of transfer of the property from one person to another person.

In a simple sense, the transfer taxes are transfer fees that the government collects from the persons getting the property transferred. Common names of these taxes are:


·       Transfer Fee;
·       Registration Fee;
·       Stamp Duty;
·       Notary Fee;
·       Real Estate Transfer Tax;
·       Gift Tax;
·       Gain Tax;
·       Capital Gains Tax;
·       Property Tax;
·       Estate Tax; and
·       Immovable Property Taxes

    My father owned a property in Lahore which comes under excise and taxation. He died and I have obtained Court Declaration for transfer to legal heirs. I have submitted an application for transfer of property in excise and taxation wit 20 rs court stamp.
    After 16 days I went to the E.T office and received a P.T 13 Form saying that transfer of property is under consideration. The PT 13 Form also require legal heir signature.
    My Question
    1. Will we pay the old property tax or new calculated tax?

    2. Please very shortly guide what will be the next steps and what time (estimate) will it take to complete transfer of property to legal heirs?

    3. Will we(legal heirs) recieve title Deed from excise and taxation when the property will be transfered?

    1. Normally, this type of amendment takes time (more that 14 days) because of the need for verification from all legal heirs on form PT-13. Keep in touch with the E&T office and facilitate the verification process.

      1 - If the recorded details of your property are the same as on spot, the tax will remain same. Otherwise, the E&T department will amend the assessment of your property to enhance your tax.

      2 - Transfer of the property to legal heirs will not take more than few days after the verification process and the payment of tax (if any);

      3 - No. Keep in mind that the E&T department will give you PT-1 ( A copy of your tax record and assessment) not the "deed" or "title documents"

    1.What will be the proof of my ownership that the property has transferred in my name?

    2. On what basis can I sell the property if not on PT1?

    1. The decision of court itself is a document that established your right to ownership. You will be able to "transfer" your property through "Transfer Deed" executed before registrar. Transfer Deed has a common name: Registry. The PT-1 of your property will only be used to locate your property and to show that the property is in valuation list for taxation purposes.

    My father is transferring(Gift) 6.5 Marla Open plot Property in my name out of 15-Marlas(On 8.5 Marla, our residential house is constructed) . Property is bearing a PT-I number but is residential. In revenue records, its notional value is Rs. 208000/Marla. What will be total transfer taxes I have to pay during this process of Hiba(Gift) registration.

    1. Thank you for your query.

      The proposition that there was no registry process in place during the years around 1966 is not a valid claim. Please note the years given against the laws below:

      1 - Transfer of Property Act 1882;
      2 - Stamps Act 1899; and
      3 - Registration Act 1908.

      These laws were adopted by Pakistan at the time of independence, in year 1947.

      As far as names given on PT1 or utility bills are concerned, they are not a valid document of ownership or title of the property.

      The option available with you is to get a decree from the court of law.

  10. Hello ,My sister bought a plot from a person A who lives in Pakistan on behalf of Plot owner B who lives in US. Person A in Pakistan write plot information on white paper and asked my sister to wait for authority letter comes from Owner B(Lives in US).
    My question, is there any worth of White paper writing , in case owner delay/deny the issuing of Authority letter?

    2. if the the house gifted is located in rural Area then 4 percent of the total value of property and if house is located in Urban Area then 6 percent of the value of house will be the tax.

This property is on my dads name only and hes been diagnosed with brain tumor in Jan 2016. His relatives are not backing him up in anyway after he has took care of then all financially. They are also refusing to leave the place and say they are never gona leave untill he gets us a big place. My dad is very sick and we feel hopeless in this situation.

    Can you please provide us with a solution to this matter as we dont have much help from anyone and our income is very low at the moment. We are planning to go back inshallah and transfer the property to my mom or our name.

    Please support and advice us to the right direction.

  29. I am purchasing a house from my next door neighbour in District Attock , punjab as a personal home . The price is PKR 85 lakh. How much tax and transfer fee , I can expect on to change the title under my name .

    2nd part of the question is that the neighbors (seller) don't have any title as it was his paternal/maternal home and the house in in village so there ar eno record . since, there are no escrow companies in the village,then how do I make this transfer happen with full security .

    1. Total tax including Stamp duty, CVT, TMA fee & Advance Tax will be 6,80,000 rs.
      According to your contention there is no record available that means said property is located in "GOL KARHA" . Just get the declaration from court in the name of seller or if there is electricity connection is in the name of Seller then its sufficient for transferring the property.

  52. I wonder if you can assist, i am an immigration lawyer however no experience in law in pakistan. My aunt has given me general power of attorney to transfer her property of 1 kanal and 5 marlas in Model Town Society to myself. We are based in the UK. Model Town society charge 80,000 rs transfer fee per kanal. however I am aware gift attracts a tax however does transfer under power of attorney also attract taxation? if so how much as it is not clear?
